    Hi,

    The last time I came back into this country, I used my AP as I didn't have my H1 stamped. My H1 is valid till 2010.

    My EAD expired last month and my bumbling lawyer did not send in the I-485 copy and hence there was an RFE. So I still do not have an EAD approval.

    Would it be safe to get paid this month or should I have my company process this month's salary after I get my EAD approved?

    Hi Friends and Administrators,

    I have a suggestion. I am sure the administrators here have much better ideas than mine but I would request administrators to please read this suggestion with an open mind. It might be useful for the community.
    I am sure we have enough members working for big companies like Microsoft, Google, Yahoo, Intel etc. The past experiences tell us that congress listens to these companies more than us even if we are making a valid point on the legal immigration issues. The irony here is that these companied care for H1 visa expansion not green card quota expansion. These big companies do not realize the benefit of green card quota expansion to them.
    Let me prove how. A large proportion of the immigration community is working for small companies as consultants. Their immigration status makes changing jobs very difficult. Now I am sure if the people stuck in GC process get there GC thousands of people will not be forced to work for consultant companies and will look for permanent jobs. And these big companies are sitting on the top of the most desired companies to work for. These thousands of consultants will be more than happy to work for these big companies after they get there GC.
    My point here is that if we can have these Companies speak for us, our voices can be heard by congress.
    How this can be done: If immigrants working for these companies as consultants or permanent can start a chain of email and send a signed copy with hundred of signatures to the management, management might think of putting these points across to congress.
    The contents of this email should be simple and achievable. Like
    1. Recapture of unused Visas.
    2. Get rid of the country quota. (This one is difficult but very beneficial).
    3. Except US graduates form quota. (This one is controversial in IV community, but if US graduates are out of the quota every one is benefited. US graduates will be benefited more, but others will be benefited because there will be less number of people to share the quota. I mention this one because this point can get big support for the universities also, and I am sure congress does not ignore a voice coming form the universities.
    About increasing the quota it is difficult and will not help much if the country quota is still exists.

    If the email submitted to the management contain thousands of signatures from immigrants working for here company and people who support these immigrants in the company management and people like Bill Gates might talk to the congress to hemp us.

    May be it is 2 cents suggestion but I would like the administrators to think out it with a open mind.

    I know for a fact that you cannot count current employer exp for GC.

    You can use experience with the same employer, but not in the same position as you note next.

    If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

    Nobody could tell just by looking at the DOT job descriptions. Your actual job and duties are what is important, not any DOL codes or descriptions. if your duties in the 2 jobs are 50% different, you should be able to use the experience.

    It's hard to answer your question without more details, such as your current status. Company B can definitely file a new H-1B for you. Your current status will dictate whether you "need" to tell them about the earlier filing. However, having a prior petition filed might not have any negative impact, so you probably don't need to be nervous about telling Co. B.

    This was a GREAT week for all of us. Past three days have changed our discussion topics and we're now more concerned about doctor appointments and certificates. That is a good thing to talk about indeed. But lets not forget this battle goes on and we all need to be together in this journey. No one knows where one will be stuck!! So please continue working with IV agenda and contribute in anyways possible.

    Those of you planning to reach the 485/EAD "heaven". Please have a look at this
    link suggesting you apply for EAD 6 months in advance.

    Apply too early and you are screwed by an early approval that will render your EAD valid for just 6 months(my last 2 were approved within 2 weeks). Apply too late and risk unauthorised work and or having to get fired/stay off the job.
    All this just weeks after they removed the ability to get an emergency 90 day EAD at the local field offices if they delayed more than 90 days.
    The USCIS is getting very mean with those of us waiting in the legal queue in my view. A lot is going on behind the scenes, I hope we are not all made scapegoats of dumb policy in the end.

    Iam on L2 and working on my EAD which is expiring on april 29 th 2011.

    I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
    we are trying to reappeal to USCIS but iam not sure if its going to work.

    Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
    They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
    Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.

    You have to wait until 1st October. Even though your H1 gets approved faster with Premium Processing, your start date is still 1st October. You will have to continue to maintain your current immigration status (L2) till Sep 30th. On October 1st, your status will automatically change to H1 and L2 becomes invalid.

    Since you get the benefit of EAD with L2, you can renew your EAD and keep working till Sep 30th. Your EAD along with your L2 will become invalid automatically on 1st October since your H1 (if approved) will take effect. (Assuming your employer files a H1 Change of Status petition and not a H1 Consular processing petition)

    Hi,

    This is my first post here. I was looking for "Experience Letter Format" that Is needed for filing I-140. I have not started my GC yet but was looking for all the documents required. It seems to be a nice idea to get all the experience letters from the previous employers before starting labor process.

    If some one has the format currently required by USCIS, please post it.

    I got EAD with "finger print not available" on card. Strangely ,Online status doesn't has any information it still displays that NSA received my EAD application and they are processing.It seems they are sending EADs but they are too busy to update their system.
    I got my EAD card even before I went for FP.It doesnt matter.

    I did it online on 3/21/09 and got approved for me and my wife on 3/31/09. 10 days total turn around! I was amazed to see USCIS's efficiency on cases filed online. I heard the opposite that if you file online it was taking long time. Mine was at NSC

    For TSC paper filing is faster than eletronic filing;).

    Your existing PERM is ok as long the acquiring company (successor in interest) keeps you in the same job (almost same job) with similar duties in the same location ( I am not sure exactly on location though it would make sense)

    Even though I didnt have a PERM case go through this scenario. I had an old style case through BEC that went through company acquisitions.

    Your attorney will have to file amendments and other supporting documents (like ability of new company to pay etc etc)

    As Fromnaija correctly explained, if you are an applicant for AOS with an approved EAD you are authorized to remain legally in the US as long as your application is pending. You Whether or not you are working does not matter.

    Is the 3yr extension based on an approved 140 transferrable to another employer for the full duration of 3 yrs?

    Yes. As long as I-140 is not canceled or revoked.

    hello experts..

    My husband and I are working on H1B visa.My husband has filed for Green card..

    Now my question is at what stage in my husdband's Green card process, will I be eligible for the visa extension
    if 6 years on H1B are over??

    None. to extend your H1 you need your own employment-based-GC process. But if you have alreayd filed I-485, you dont need an H1, you can continue working on an EAD based on his green card process.

    If I also file for the green card, I get labor cleared and just in case I lose the job.Then what options I have
    for visa extension?

    If your company is willing to continue your GC (unlikely if you lose your job there) then you can get extension while that LC is valid (labor remains valid for 180 days, during which an I-140 must be filed). If you get past I-140 approval with this company, then you can use taht I-140 for extensions as long as this company does not revoke the I-140.

    If I join another company do I have to have again labor cleared to get additional visa extension
    at the completion of 6 year?what happens to priority date,can I use earlier GC filing priority date?

    Yes, you would need to restart the labor unless the previous company gets to I-140 approved stage and is willing to not revoke it. If you get I-140 with current employer, that priority-date is yours for future GC applications also. If you dont get to I-140 approval, then the date does not carry over to the new GC application

    Respected Madam/Sir,

    I have an issue with my H1B application. Please help me.

    I attended my H1B interview at Mumbai Consulate on 02nd Dec 2010. At that time Officer told me that you are qualified for H1B Visa but company is not good for you. Officer convinced me to withdraw the petition.
    Then they gave me one form and asked me to sign on it and write you are withdrawing the petition.

    Next day I called my sponsor and told everything. But sponsor told me that he is ready to provide all the docs and few applications already approve at consulate Hyderabad.

    On 20th Dec 2010, I took new appointment and went for interview. At the time of interview I told that "I withdrawn my application as per suggestions given by Visa Officer, But my sponsor had a debate with me and put forth the point that they are not violating any norms and laws, and thereby ready to provide all sorts of doc.Please reconsider my application as they offered me very challenging role".
    Then Officer asked few docs about my sponsor and asked me to come directly to consulate with passport and gave me 221 G blue form.

    On 5th Jan 2010, I went with my docs and Visa Officer granted me VISA and now I got the passport with VISA.

    But, on 4th Jan 2010, just before one day, I got a below mail from Consulate Mumbai.

    Dear Sir,
    Based on the interviews and documents submitted at U.S. Consulate General Mumbai, we have returned your petition to U.S. Citizenship and Immigration Services (USCIS) for review and possible revocation. If a consular officer receives information during the interview process that was not available to the adjudicating immigration officer at the time of petition approval and that shows the beneficiary of a petition is not entitled to the accorded status, then the petition must be returned to USCIS for re-examination. Due to this requirement, consular officers returned your petition and additional supporting documents to the Kentucky Consular Center.
    You may address further inquiries on this petition to the USCIS National Customer Service Center at 1-800-375-5283.


    Now I am US, and Officers didnt asked anything at port of entry.

    But in USCIS website, the petition status is showing that they recieved my petition from state department and they are reviewing it.

    Can I get the SSN and Am I legal to stay in US. What should I do. Please let me.
