    As we watch the earthquake destruction in Haiti with horror, one group of individuals that will likely start to get attention is the population of Haitians currently in the US and who are obviously not going to be able to safely return home anytime soon. US immigration law actually has a system to handle precisely this situation. It's called Temporary Protected Status and it is available to individuals who are from country suffering armed conflicts, disasters, or other extraordinary conditions. The Secretary of Homeland Security is empowered to determine which countries are on the TPS list. People in TPS status...

    While we look at this from an immigration and DHS rule making - in reality, there is large scale devastation and catastropic loss of life.

    My application is recieved by R COOK on 10th July and no news yet.
    My 140 is approved on 08/17 just 2-3 days before.

    Not sure whats going on.

    Are they also getting new I-94 every time...:confused:

    I forgot that. they Do not need new I-94 every time. But I remember We were asked to put all Entry to Canada on I485 papers . I use to go Toranto Every week at that time.

    Hi,
    I have 2 lawyers to select from. Both are good. One of them is the lawyer company (his office locate in the same city) which is the most expensive. The other lawyer is really good and his expenses is pretty good.

    My question is that: Is it better to stuck with the company lawyer as he can handle the perm better. That may because he knows well where to advertise? Or it does not matter? I am just worried that the lawyer that live in another state will not know very well about the city and where he should advertise.

    As anyone think, I also want to make sure that he does not over advertise such that we may get many applicants?

    Please advise me if I should stuck with the company lawyer or it does not matter?

    I am totally lost on what to do.
    I read in the other post that if PD become current in the bulleting then Iwill be in trouble if I have not filed for spouse. I am lost with this !!

    Thanks guys. Nik, my boss took the decision out of my hands and had me order the 2 lense option. I'm hoping it's compact enough that I can hike with it. If so, he said he'd take my Canon Pro1 for the shop and I could have this. If I take it, then I'll look into your suggestion.

    No one can guarantee you what you will be asked for. Take everything that you normally need. Legally company MUST give you pay stubs in some form (electronic or paper) if they have paid you. What is the reason for not generating pay stubs if you have worked there after I-797 approval notice or even just after filing? Visa stamp on passport is not required.

    Today I found out there was a soft LUD on my I485 application. I am not sure what it is. How can I find what is going on with my I-485 application. Befre that there was a soft LUD on my travel document which I file in 2007 after that I did not file that. I just want to know what is going on with my application. Please let suggest.

    Is it at Texas or Nebraska?

    Hi,

    This is my first post here. I was looking for "Experience Letter Format" that Is needed for filing I-140. I have not started my GC yet but was looking for all the documents required. It seems to be a nice idea to get all the experience letters from the previous employers before starting labor process.

    If some one has the format currently required by USCIS, please post it.

    Hello,

    I am here on a H1B visa and my wife is on a H4 Visa. She has recently been admitted to a masters program and would start going to school soon.

    1. We want to get a F1 visa for her, so that she can get paid for some work in the campus. Would it be possible to get the F1 visa in Canada. Does anyone have any recent experience on getting this done ?
    2. Say we not apply for a visa but only apply for a change of status and do not even go to India or anywhere else before the completion of her program. After that she would go on an OPT. If we go to India then, would it not be a problem in getting a F-1 visa, as her education would already be complete. Does it mean that she should get her visa stamped before she completes her education.

    Hi Gaurav-

    I do not recommend getting a stamp from canada. Sometimes the Consular officer there can not ascertain her past academic record and her F1 may get rejected. I think you should file I539 to change status. That is safest. If, by chance, I539 is rejected, she can apply for F1 at US consulate in India.

    I would advise that you guys travel to India one semester before she completes her studies. One of my wife's friend did that and her F1 was approved despite changing status in US from H4 to F1.

    My wife is also in same situation and has F1 status after changing it from H4. She will be graduating this summer but we may travel to India as not travelling will mean she is away from her family for too long.

    I got the email today, per email card production ordered on April 12th 2008.

    Filing dates as follows:
    485 filing date July 27 2007:
    485 Notice date Sept 26 2007
    I140 with LC SUB EB-2 with PD July/2001 approved on Jan 2008

    I had spoken to couple of Attorneys and they have told me that H1B will done with in two weeks this year. Therefore, anyone looking to apply, get your ducts lined up.. There is not much time left..

    When to File.
    Generally, a Form I-129 petition may not be filed more than six months prior to the date employment is scheduled to begin. Petitioners should review the appropriate regulatory provisions in 8 CFR which relate to the nonimmigrant classification sought.
