    Really appreciate it.


    My problem is in few days the date for visa appointment will be open i.e Jun-13 and I will be booking for that date. I'm flying on Jun-10 so I'm left with exactly 5 weeks, in this time will I be able to get the new LCA and amended H1 ?

    I did it about 10 days before scheduled date in July. Went around 2 PM. The guy at front desk was reluctant but let me in due to my case being genuine pregnancy after discussing with supervisor.

    You don't need to send anything - they already have your I-485 application. They will ask if they want. After few weeks of e-filing, I was called for "biometrics". They only took my picture, and that was it. On 11th week I got my EAD. Mine was same as yours: first EAD but having one prior OPT. I mentioned OPT EAD in my application.


    Thanks bestia. I am hoping they wont need to call me in for biometrics since i already got that done for my 485. but its uscis...who knows what they do.

    Hi there,
    Besides my lawyer. When I went to Info Pass they told me the same thing I can't file for the I485 untill the I130 is approved because I was in removal proceedings when we got married. Info pass also said that I130 in removal proceedings is handeled differenty. I don't have a work permit or social yet since i can't file for I485.

    Why you take lawyer's help for this simple thing. ?
    Almost everybody renewed EAD/AP by themselves.
    EAD/AP filings must go to your I-485 processing center.
    I think, if the lawyer send to wrong center, it will redirect to the correct center, there will be a time delay for this.


    Same here! Our lawyer send our EAD,AP renewals to NSC,even though my 485 is pending at TSC(Last July got transferred from NSC).Till far no LUDs no any thing regarding them.I applied on June 30th and till far no update.Is this normal?

    thx for ur inputs newbie2020. yes, i know that it is a conditional GC to start with.

    my concern was - as far as i know, i cannot work actively for my own business on H-1B. hence i wanted to know if i could continue working on H-1B, apply for GC under EB-5 and then start the business after getting it.

    attorneys, do u hv anything to add to what newbie2020 has said?

    Here is my h1b status:

    1. We have applied for H1B visa extension in premium on March 23rd, 2010.(for 15 months, as I have this period remained on H1 6 years and I-140 not approved yet).
    2. I have joined new client on March5th new project, new location.
    3. USCIS raised RFE on March 9th, 2010 but not received the RFE document.
    4. My employer sent H1B Amendment documents on March 15th, 2010 with new LCA.
    5. Received RFE document on March 30th, 2010 from USCIS and replied on March 31st to USCIS.
    6. USCIS approved case on April 10th, 2010 with 1 year duration, which is May 2011.
    7. USCIS approved amendment on Dec 5th, 2010 which is valid until Aug 20th, 2011 which the max of 6 years period.

    Now question, it means my H1B visa valid until Aug 2011?

    I did masters and worked on OPT for sometime with Company A and they applied H1B,
    still working for Company A as H1B as Senoir Programmer ANalyst.
    At one point CompanyB filed GC process and I-140 approved as a IT Manager in EB2
    PD=jan 2006
    Still working with H1B from COmpany A
    I never worked for Company B and it no longer exists...
    Company A recently merged with ANother Company X
    I recently got an RFE How do i respond PLease help me:
    Below are the details



    Please submit a properly completcd Form G-325A, Biographic Information Sheet, for yourself. Your original
    signature is required on the Form G-325A. Photocopied signatures are not acceptable. Blank immigration forms
    and information are available online from the official Service website: USCIS Home Page. You may also ordcr
    immigration forms by phone at 1-800-870-3676.


    Submit documentary evidencc to establish your employmcnt history listcd on Form G-325A. Such evidence
    should include, but is not limited to:

    Clear copies ofIRS Form W -2 wage and tax statcmcnts;
    Pay vouchers;

    Complete copies of properly filcd Federal Individual Income Tax Returns (IRS Form 1040);

    I and my family have to travel to India urgently due to medical urgency. Our only AP document was taken last year and this year the renewal is not yet done. We are using our EAD status and H1 is expired and no longer available.

    Is there a way I can get an emergency appt and a AP travel document. if yes, what do I need to do to get that.

    If this question has been answered earlier, can someone point to the right source.

    Check with the lawyer first...I don't think you can apply for AP while you are outside U.S. I know for sure, Reentry permit will be denied if you apply from outside U.S. I am not sure if it's the same for AP. Incidentally, you use the same 131 form for both...

    So check with a lawyer before you act based on the advice from the forum, even if it means shelling some money...That money will be well spent...

    I don't think there is any site in this world which can give US visa status after the interview.

    Interviews are conducted by govt officials and not just other websites, but the consulate offices are also not maintaining any sites to track the status. I am 99% confident about this.;)

    Hi,

    MY labor says that the candidate needs atleast 1 year exp as a Software Engineer. Your labor says at least 1 year exp
    But my experience letter says that I have 2 years of experience as a Senior Software Engineer. You have 2 years exp. then you are good to go :-)

    Would that be ok ? (Actually I was a software engg before and got promoted to Senior Software Eng later.)

    If so, can I start working for that employer once he files a new petition, or do I have to wait until the new approval notice?

    If you can, I would suggest to wait a month at the least. Information is changing by the day and you will have a better picture of where the case is leading to in that timeframe.
