Dear Experts I need this suggestion ASAP to prove I-140 ability to pay.
My Priority Date EB3 is Apr, 2004 and Company is in Loss for '04,'05 and '06 and so can't prove Net assets is greater than liablities or revenue is greater than proffered wage. However Company recently has been approved for line of credit which is greater than(>) the proferred wage.
The only way to show the ablity to pay is by showing the w2 that I have been paid the proffered wage since the priority date which is April 04. But I did not work from Jan'04 though mid of '05 because of health reason. During that time, I was paid by the disability insurance from the employer and I paid the tax for disability income while filing the W-2.
After I joined back on mid on '05 I have been paid more than proferred wage till present(June'07).
Does that satisfy the USCIS of the requirement of ability to pay or Not???

Although Dphoto has a very active Canon forum, this site is about the image first. Gear at the higher levels is more a matter of personal preference. Nikon has some very strong points. For example ergonomically, the D2H is fantastic. What are the things that enticed you to choose Nikon?

I do not want to renew the advanced payroll, since I do not foresee travel within the next 18 months overseas. Is there a way I can skip the renewal this time around (1-year extension) and renew it the next time? If there is an emergency, I can still go to India and have the Visa-stamped since we have a valid H1/H4 right?
Are there any risks here?
As I read from your post, you are saying that you do not have H1 visa stamped in passport. These days consulates in India are pretty tough and they are issuing 221(g) etc for H1/H4 visa. And you could be denied visa for no fault of yours. It happened to my wife and it took 3 months for the consulate to get the clearance. So think about it. Personally for me AP is a very important document it allows you to travel in case of an emergency.

Only thing to note is that your employer should have enough profit to pay you and possibly other I140s applied by him. Might be an issue for small consulting company.

I have a question which I hope someone can help answer.I have applied in EB2 category and am from India.My PD is July 2005. I have used AC21 recently and changed my employer(i.e I am no longer with my sponsoring employer) I have not notified USCIS of the same.
I plan to travel to India during September 2008 and use AP to reenter back into the US. Can someone help answer the below doubts.
1) Since at the port of entry the Immigration Officer will ask whether I am still with the same employer or not- I will have to say I have moved to another company- What happens then?
2)Does using the AP and subsequent answer of "Yes- I have changed my company" trigger a RFE during the GC allocation process since now I have to prove to USCIS that my job is "same or similar" and my pay is >= the pay mentioned in my LC.
3) Has anyone successfully used AP after using AC21 and not had an RFE issued during GC allotment?

This is for EB5 .....but doesnt it require you to employ a minimum of 10 people?

Your situation isn't too tough.
Yes you will need a new F1 visa to re-enter. Nobody knows your chances of rejection, just take all the docs and hope for the best.
If your F1 gets rejected then you can come back on valid H4 - I don't think they will cancel other valid visas. However once you are back here you'll have to again apply for a COS to

I guess, you need to enter the "Received Date" that is on your last I-765 receipt Notice.

Thanks, both of you. I got it yesterday, did a few test shots in a creek by my home and took a bunch of pics in the Black River this morning. In a fast riffle, there were some streaks from bubbles, but that didn't detract from the shot (subject was a smallmouth bass close up). In fact, I think it added the sense of current flow.
The Black is a very clear river, but it is not like the ocean. Looks like the closer the subject the better. I'm also learning how to process these images. I've been shooting for about 40 years, but this is a whole other world, and I'm on a learning curve. It's cool, though.
