I (Indian citizen) am on H1B and wife is on H4 (Canadian citizen). If we plan to get some franchisee and invest money from our savings, will she be eligible for E2 visa and work as an owner?

HI All
I am worried about my employer. Given the fact about I-485 apps and the last few days of labor in the previous month I have doubts about my employer. He is a very mean and hopeless desi employer and I am worried if he sold out my labor to some high bidder. is there any way i can find out if my labor is still infact in my name. any thoughts

does that mean no hope left ? what r the other options ? isn't this whole process is for future employment and if i am licensed now than whats the problem in future employment i don't understand that part "future employment". i am on h1 now and if i will get my residency than i will be working at that position and i am licensed now. then why does the old date matters.

Because the LC is for a particular qualiication that needs to have happenned at that time - would it be ok if they calculate a new LC salary by adding the inflation?

Looks like lot many ROW eb3 PD between AUG03-AUG04, 42% so far.
Good news is not many ROW eb3 for AUG03. Date will going to move definately.

My limited understanding about the GC process is that from the day I-485 is filed, a person may change his/her job only after 180 days or more, and of course by filing AC 21.
Also, in case the I-485 does not get approved within the 180 days after filing, then how can a person change a job without having an EAD.
A person can EAD only once I-485 is approved? Is that correct.
Please throw some light on the above points. Thanks in advance.

Yes, a friend of mine was not given her VISA they did not say denial instead said they needed to further confirm her qualifiactions and field of research. This is bc she works in boitech and at that point there was the anthrax scare.

I am in the same boat.
Approved I-140 in EB3 category. Current employer wants to file in EB2 category, they gave me a new job that qualifies for the category but my Attorney says that I have to withdraw my current EB3 application..
I have read so many post here and every where that tells me that it is possible to continue the process but my lawyer says that I need to withdraw EB3 case.... Any one knows good lawyer around DC Metro area with good experience for Eb3 to Eb2 transfer with the same employer
You do not have to withdraw your EB3 application. You are doing the right thing by trying to find a new lawyer.
