I need to file for my tax refund now, but my employer is not sending me my W-2.
I used to work in US for 3 months under a program called Work and Travel. My employer is supposed to send me my W-2 now, but they haven't. When i checked with them, they told me as they never received my social security, a W-2 was never issued under my name. But the fact is that, they sent me an email last August telling me that they sent out my social security card on 23/07/2008. However the problem is that as they did not note down the correct address, the mail was lost (Anyway i am going to the US Embassy in my country to retrieve it). So i think they were cheating.
When i told my manager about this email, she explained saying that it was not about the social security. She said the W-2 was sent to them after i had left US, so while they never had it when my checks were issued. So it was never sent to their corporate as i am no longer working for them. And i think they are cheating me again.
I do not really understand how this works. Is her explanation reasonable?

I wonder when the USCIS will learn to stop playing games with our lives?

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
Check your I-797 - receipt notice for your I-485. In that there is a received date. That is your RD. There is another field, notice date or ND that might change depending on the transfer. If the RD is different from July 2nd, you can talk to the customer service and try to get it corrected.
BTW, though they have to process in the order of RD, I don't think they are following it. From reading here and other forums, I think they are following the ND.

I can see potential, but the shot doesn't do much for me. What does interest me is the interplay of the branch, stump, and light on top of the stump. Can't tell if there's anything there, but might be worth exploring. Other angles might make the overall stump shot more interesting. Hard to say.

clarify21: You can not have two status (ead & h1b) at the same time. Either your are on H1B or EAD (Pending AOS). If you would like to maintain the H1B status, for the part time job, you will have to ask your part time employer to do the new H1B; by having two H1Bs you can work for two employers the same time. By doing this, H1B and EAD both are valid. The moment you use EAD, your H1B status is invalid. Have a talk with your attorney. Hope this helps.

I have similar situation.
I changed my employer last year and used AC21 / EAD. Now I want to return back to old employer who sponsored my Greencard. Is there a way to withdraw AC21?

Since 7 years I was working on EAD and now I am thinking to convert into H1B , since I am planning to get separated from spouse.(my GC process is dependent on my spouse).
I was not on H1B before.
Q1: Once I get my H1B, will my EAD gets revoked or can I maintain both H1B as well as EAD?
Q2: If I get divorced, will by EAD status becomes invalid from the day1 after divorce?

Offcourse they have entered A# time of the finger print I even gave them my EAD card along with ID which has my A# on it and entered it from there. A# is also on FP form which you have to fill out if you have A#. Hope that helps.

"AILA has reported that the BECs are still processing April 2001 traditional cases for the traditional case track and it is not expected to move ahead for sometime due to the huge number of 245(i) cases which were filed in April 2001."
I think we will not see a lot for Traditional Cases for a looong time.
My NON-RIR - PD - 04/2002 is also stuck in BEC.
Last i read was that the NON-RIR labors were being processed first compared to the RIR ones. So think twice before u take any decision.

My attorney has asked for the I-485 to be printed:
double sided with Flip to Top option.
Did anyone else do the same?
for what its worth I printed mine single sided. I hope USCIS is not as nitpicky as your lawyer. I printed in black ink, maybe if it was pink or green or orange they might raise an eyebrow, otherwise I hope they dont really care

I recently sponsored for my uncle and his wife and had no problems. Just send the sponsor docs with I-134, letter to consulate etc. Uncle had to provide info on his ties back in India.
My last name was not same as uncle's ( guess that is what your doubt is) and that was not an issue at all.

Hi ,
I was on F1 visa till oct 2008 and then a consulting firm file for my H1B . It was approved and my status has been changed . I tired a lot but i didn't get any project and i am on bench till oct 2008 and i am still on there H1B. Although in the mean time i was enrolled in school and never quit the school as i am working on my project in school and i always had valid I20 and valid I94 and F1 stamped on my passport till dec 2011. I am still enrolled in school.
Now my emplyer is saying to file COS and go back to F1, but i don't have paystubs and he is not giving me as he said being a bug company we dont do this.
I talked with a attorney he is filing my COS.
1) is there anyone in the same situation evr ?
1) Is there any other way i can follow?
2) what percent are there chances that my COS will get denied or accepted?
3 ) My employer is still marketing my resume?
Any Suggestions welcome!!

This is because most of the beneficiaries are not eligible to file in the past two years. It was not like that before. Once for some reason if they allow the people to file, the graph will peak to 900days.

Post MBA (since Jun'06), I am working with a new employer. My previous employer (bachelor degree), filed for my labor in Nov'04 and I left this company in Jun'06; howevr employer didn't withdrew my labor application. My labor with previous employer was approved in Feb'07. I have good relation with my previous employer and they are ready to file my I-140; I have few questions regarding this:
Can my previous employer file I-140, even if I am not working with them?
YES
If I-140 is approved, would I able to transfer the PD to my new employer, when he initiates my labor application.
YES, you would need a copy of the I-140 and since you have good relations, it should not be an issue
Once I transfer my PD, can my previous employer use this approved LC for other candidate?
This is a grey area. Not sure but I believe post-April, approved LC would have a validity of 45 days or so - so it may not be reusable. From your point of view, I'm not sure if the LC does get reused, does it impact your PD or not - my take is it doesnt but I'm not a lawyer.
Based on my new qualifications (MBA), my job description has changed totally compared to my previous job.

As far as I know Boeing, NASA, Raytheon etc. who recruit candidates from West Coast and some East Coast schools, pay great salaries to fresh graduates who are US citizens. If engineers expect to be making anything close to the bloated salaries in Finance, they are in the wrong major.
Doesn't it still mean that there's a shortage of people willing to work in Engineering and they have to import that talent?
It's like the time in school, when the only people willing to work in on-campus restaurant jobs like Subway, Wendys etc. were desis or Chinese: because the salary per hr was minimum wage and lot of American kids felt its beneath them to work there. It did create a shortage of people in that line.
I frankly don't understand the line of reasoning followed by Lou Dobbs & Co.
